Under and by virtue of the Power of Sale contained in a Security Deed given by Robert H. King to Bank Of Upson, dated September 21, 2007, recorded in Deed Book 724, Page 131, Pike County, Georgia Records,conveying the after-described property to secure a Note in the original principal amount of one hundred nine thousand two hundred and 0/100 dollars ($109,200.00), with interest thereon as set forth therein, there will be sold at public outcry to the highest bidder for cash before the courthouse door of Pike County, Georgia within the legal hours of sale on the first Tuesday in May, 2011, the following described property:
EXHIBIT “A” All that certain tract of land, together with all improvements thereon presently known as 2249 Main Street, containing 2 1/2 acres, more or less, situate, lying and being in the Town of Molena, and int eh West part of Land Lot No. 226 of the 9th Land District of Pike County, Georgia, and more particularly described as follows: (reference being made to plat of property of R.H. Beginning at a point on the West right of way line of State Highway No. 18, at the Southeast corner of that certain property designated on said plat as the former homeplace of Mrs. Ada E. Fletcher Estate in Land Lot No. 255 (lying West of and adjacent to said Land Lot no. 226); thence Northerly along said Fletcher tract a distance of 210 feet to lands formerly known as the Mrs. Ada E. Brooks homeplace; and thence Easterly along the South boundary of said Ada E. Brooks homeplace 610 feet, more or less, to the point of beginning on the West boundary of State Highway No. 18. This is the identical real estate conveyed to Martha Hall and Howard Hall by Warranty Deed of Arthur J. Hausmann, Jr., dated December 12, 1998, of record in Deed Book 121, Page 34, said Clerk’s Office. Said tract is conveyed and accepted subject to reservation by James H. Fletcher of a water line easement along the Northerly 5 feet said tract as contained in that certain deed from James H. Fletcher to Joel H. Whitten, dated May 25, 1971, and recorded in Deed Book 47, Page 619, in said Clerk’s Office. Said property is accepted and conveyed subject to restrictive covenants and easement reservations that affect said subdivision, of record and utilities and rights of way that actually traverse or border subject property. The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in Security Deed and by law, including attorney’s fees (notice of intent to collect attorney’s fees having been given).
Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.
